about the will

Querist : Anonymous (Querist) 27 December 2010 This query is : Resolved
respected sir,
my query is as follow:

my grandfather wants to give me his self acquired property through will.he has 2 sons and a daughter.i wants to know that if he give me his self acquired property can my father or my uncle or aunt claim any share in the property given to me. property is self acquired no inheritance

thanks for your advice
R.Ramachandran (Expert) 27 December 2010
If it is the self-acquired property of your grand father, he has every right to dispose of the same in any manner that he likes. He can gift it to somebody. He can give it through Will to somebody. He can give it to some religious/ charitable purposes etc. etc. Nobody can question him or object to his actions.
Therefore, if your grand father wants to gift his self-acquired property to you through Will (without giving it to his own sons / daughters) he may do so. Nobody can claim any share from the said property from you. HOWEVER, they can challenge the validity of the WILL on the ground of coercion, undue influence, pressure, fraud etc. etc. If such a challenge comes, then you may have to defend the same.

I also agree with Mr. Ramachandran. Will of self acquired property can not be changed by any person. It is absolute power of the owner of the self acquired property to dispose of as he wish.

No they can not claim . Ask your grandfather to transfer that property throguh gift so that they could pose no threat to the validity of such transfer.
