498A Chargesheet

In response to my RTI the concerned IO has replied that he has filed the chargesheet in November but I have not received the summons from the court yet. I checked in the CJM court and there they say that it comes through CO office. So how long would it generally takes for the Chargesheet to reach....and post receiving the chargesheet would the court issue us summons as some of us are under stay of arrest and will need to secure regular bail from the trial court.

will it be a issue securing a regular bail for the co-accused the sections are 498A, 3/4 DP, 406. The main accused me already secured a regular bail.

If main accused has been granted regular bail then there is no hurdle for others. Accused persons have not to care for the charge-sheet as they have to appear only after receipt of summons and till then all those accused persons are on bail before arrest. Generally it may take a month time in the court through the office of CO.

Is the chare sheet lying wth the case record and only it is you whov has not receied the summons of its submission? If the answer is yes then go for regular bail. However in absence of submission of CH you could also pray for regular bail.
If the CH is filed then you could also get it by applying for its certifed copy.

The summons will be issued by the court only after it takes congisance of the offence after analysing the charge sheet thoroughly.It will take some time and you need not and caanot hurry.
