Notice u/s 160 Cr Pc

Hi

if a person has received notice under the head "Notice to witness u/s 160 cr pc" and the hearing is at Delhi whereas the person stays in Mumbai is it necessery for the person to attend the case?

and if he will not attend it what are consequences?

He has to attend the court hearing or else engage advocate to get time based oin your convenience and then attend the hearing accordingly.

Section 160 Cr.P.C. empowers the police to require attendence of witnesses during investigation...... So you,ve to go n helps in investigation......

CR.P.C. Section 160. Police Officer’s power to require attendance of witnesses.

(1) Any police officer making an investigation under this Chapter may, by order in writing, require the attendance before himself of any person being within the limits of his own or any adjoining station who from, the information given or otherwise, appears to be acquainted with the facts and circumstances of the case; and such person shall attend as so required:

Provided that no male person under the age of fifteen years or woman shall be required to attend at any place other than the place in which such male person or woman resides.

(2) The State Government may, by rules made in this behalf, provide for the payment by the police officer of the reasonable expenses of every person, attending under sub-section (1) at any place other than his residence.

Avoidance of such notice may be an offence under 172 and 174 IPC, and police may act accordingly.

If the complaint is against you you need not attend the hearing. If you are called as a witness you have to attend. The police has no powers to summon the accused.
