Flat - Monthly maintainance

Hi,

We own a flat in Mumbai, the flat owner ismy mother
i have a query and a problem

Problem
Though we have been paying our flat's monthly maintainance money regularly
Treasurer appointed to do this job very regularly acts funny for e.g
We get the bill of monthly maintaininace on 12th and within in 2 days of receipt we make the payment however this time the payment was not accepted and we were told you have to pay by the 5th of every month
so we sakd thewm to send us the bill by the 1st of every month however they did not respond and return the chq saying this will only be accepted in next month now
in this case we said if you are not accepting it we shoudl not be paying any fine -- for which again there was no answer
please advice what can we do legally to ensure we are not penalised on late payment and fine as there is no documentaion that can prove this that they did not accept the chq
also what answers legally can we keep ready to ensure they know we are not fools and know a bit of rules

This month the date on the bill is 10th but actually handed over to us is on 12th Oct, we handed over the chq on the 13th of Oct but the lady returned it back

also this is handed over by the building watchman its a hand delivery and they do not take a signature after they handover the bills

2 these bill you get by which mean by post or by hand
3 sender get your receiving signature or not?
4 penalty is pre- decided ?

the bill was received on the 12th Oct however the bill preparation date mentioned in the bill was of 10th Oct

2 these bill you get by which mean by post or by hand

3 sender get your receiving signature or not?

NO
4 penalty is pre- decided ?

The penalty amount was shared but no period defined as to after what date will be the penalty be applicable ( as in after handover of the bill if not paid in xyz date the penalty is applicable)

Communicate with the treasurer in writing. From what I could gather, U do not have any problem right now. If a fine /penalty for late payment is imposed, approach the civil court.
