Shall my brothers or their heirs have any claim?

Querist : Anonymous (Querist) 05 October 2010 This query is : Resolved
Respected Experts,

We are 4 brothers. My father purchased some landed properties on my name, when I was minor. Now I am 55 years. Plz. clarify that my other brothers or their legal heirs are having any right or claim against the said property.

Your brothers can claim any time

Your case may be covered by The Benami Trasactions (Prohibitions) Act, 1988.

As per Section 4 to be above act, if the property was purchased in your name by your father, then you would be considered the legal owner and others would not have any right. However, it can be argued (against your claim) that the property was in fact a HUF property to which Section 4 would not apply.
