CHARGE SHEET FILING

(Querist) 24 September 2010 This query is : Resolved 
The local court has ordered to register and investigate the case. The FIR was registered on a particular date in July 2010. Coming to know about the FIR the accused awarded anticipatory bail in Aug 2010. The charge sheet has to be filed after investigation in how days? Is it from the date of FIR or from the date of acceptance of the bail order?

There is no time limit for filing a charge sheet.

Right, it depends upon the investigating authority to submit the charge sheet when it desires though the court can indeed ask it to submit expeditiously.

It is always from the date of FIR. But there is no time limit prescribed though undue delay is always considered to be in favour of the accused. Courts have held that there should not be inordinate delay in the framing of charge sheet. If there is any such undue delay then the case can be quashed.

it is true that there s no time limit fr filing of charge sheet it depands on the investigating officer as about when to file charge sheet however, if undue time is taken than one can approach to high court to seek necessary directions against the concerned investigation officer, Generally to cause delay in trial , investigating officer doesnot file chargesheet in time

Though no time limit is fixed for filing of charge sheet. But it is regulated by Sec 468 Cr.P.C as court is barred after a fix period in taking cognizance of offense. But it depends on, what offense is disclosed in charge sheet. Time is counted from the date of FIR.
