(Querist) 18 August 2010 This query is : Resolved 
Once chargesheet is submitted u/s 34, 120B, 420, 409, against two accused. There is stay by high court till submission of charge sheet. I have three questions: 1.What remedy is available to accused after submission of chargesheet. 2. Is the above offences are compoundable and compromised before the court. 3. Is permission of the court is required to compromise in the said case. what is the legal position.

Dear Mr. Vijay,
1-After submission of c/s, u have a remedy to approach before high court by means of its inherent power under Section 482 of Cr. P. C. with a prayer of quashing of c/s.
2/3- no offences are compoundable except Section 420 IPC and without the permission of the court it can't be possible. Kindly See Table II of Section 320 of Cr. P. C. of better understanding. I hope ur quarry be resolved.

As per my view ,Comprimise shall not allowed in non compoundable offences.
