how a arrest warrant can cancel in case of 138

Dear Anonymous,

The arrest warrant can be issued as a coersive measure in the eventuality of non appearance on the date of hearing with a view to ensure the presence on the next date of hearing.
One has to immediately approach the concerned court with a written request to set aside the arrest warrant enumerating the reasons of not being able to attend the court proceeding.

it is under Sec.70(2) of cr.p.c. file a petition to recall the warrant giving justifiable reasons.

since offence 138 is bailable, NBW can be cancelled and accused can be released on bail/ or fine may be imposed.
