Regarding issue of fresh share certificates for coop housing society maharashtra

1.due to various misdeeds of previous secretary complaint was made
2.registrar took over society appointed administrator
3.subsequently administrator set right basic issues
4. administrator/registrar appointed election officer
5. fresh elections held
6. new management comm. elected
7 when new office bearer asked former secretary to handover all records he refused
8. judgement given by dy.registrar against former secretary u/s 146 of Mah. coop soc. act for non production of books, records etc.
9. present members want to make sure that no fraudulent party has been issued share certificates
therefore:
we propose to issue fresh share certificates with security features etc. in lieu of old ones.Ask each member to produce old one to check the authenticity and deface the same after issue of new certificates. Some members paid in cash not given share certificates. For such members on basis of receipt issued by former secretary issue new share certificates as copies of old share certificate(blank) not available.

question :what are the due diligence to be followed for issue of new share certificate and do we require to obtain prior permission of registrar ?

9. During panchanama by registrar, collector office, police in former secretary residence he gave in writing that he does not have any records.
9.judgement given by dy.registrar against former secretary u/s 146 of Mah. coop soc. act for non production of books, records etc.
10.yesterday we came to know from reliable sources that the former secretary has one more office premises in new mumbai.
Question : can new MC /office bearers approach police to seal this premises and again ask registrar/dy.registrar to search for records - we suspect he may have kept his illegal dealings, duplicate records at that premises. how to make sure he is not alerted.

Get acceptable / solid proof that the former secretary has kept the record at that place and then proceed.

Engage an able counsel to examine all docs on record, relate with rules, and to support and advise in the matter.

1. Duplicate (NEW) Share Certificate CANNOT be issued to members, without following due procedure of law, which is very lenghty and requires a professional hand.

2. It would be claimed that the "Duplicate (NEW) Share Certificate" is biased and false and forgery, by any member, who strategically wishes to do so.
