Building rules

I am residing in the residential building in my property which is adjacent to some shop rooms. The owners of the shop room is constructing first floor violating building rules. Can I file an injunction suit against them without arraying the concerned panchayat.

Yes, you can move to the Court and seek an injunction through a local prudent lawyer.

Instead of filing any suit, you just report to the building plans department of your Municipal office. They will take action if there is violation of building rules..For filing a suit you do not have any cause of action.

Sir my question is whether I need to array the concerned panchayath as a party in the suit ?

You should inform concerned authority regarding unauthorized construction. If not stopped, move to court for injunction. In such case concerned authority can also be a party.
