Transfer of share of deceased co-owner

(Querist) 23 November 2018 This query is : Resolved
We have a flat in a CHS in Mumbai with me as the 1st owner and my deceased dad as the 2nd owner. Now i have to cancel/remove my dad's name from the share certificate. Legal heirs are my mom, my brother and my sister and myself. What is the procedure i have to follow to get this changed from the Housing Society?

(1) For share certificate : Submit the share certificate, and a copy of the death certificate of your father with a written application to the Society to remove his name from the share certificate. (2) For share in property : Apply for probate in case of a WILL and letters of administration in any other case.

Was any valid nomination made?
Is there any dispute amongst relatives/legal heirs of deceased?
Have you checked with society office?
If yes what are the documents asked by society office?
Is there any dispute or misunderstanding due to which you are seeking opinion!

If NO then society might have advised you IT's views on simple and easy recourse's.

Apply to the CHS for transfer of share in your name, which should be accompanied by relinquishment deed, affidavit and NOC from other LRs of deceased, if he has nominated you.
