Case u/s 156(3)

(Querist) 29 September 2018 This query is : Open 
Police did not register FIR and caseu/s 156(3) filed and status shows A Versus B and not A Versus State. Does it means the opposite party will be summoned and not police.

Provision of Section 156(3) Cr PC is meant for Magistrate to direct SHO for lodging FIR wherein police do not have discretion.
What police have mentioned i.e. A Vs B or A Vs State or any thing else, do not change character of the complaint, isn't it?
As per status report JMIC or MM (as the case may be) shall direct. Wait and watch for next step.
