Presence of parties on the day of decree

(Querist) 19 July 2018 This query is : Resolved
Is it mandatory for both the parties to be present in court on the day of decree to be given for contested divorce. Last day judge heard from both parties and both of the party agreed to all terms.

Due to time constraint last day i.e 29.06.2018, judge could not give the decree and given a next date of 26.07.2018.

On this 26.07.2018, is it necessary for both bride and groom party to be present?? Or the judge will give the decree if the lawyers of both parties be present??

Lawyers can present parties before court. However if court has insisted parties to remain present then parties has to remain present before court. As you already appointed advocate consult with your advocate.

For hearing the final order or collecting the decree of divorce from the court parties need not be present in person. The advocates of both parties can apply and obtain certified copies of the order, judgment and decree of the divorce and give it to their clients.

Sirs,

Really thank you for the replies... Court has not insisted the parties to be present. We were present on all hearings. The advocate of other party remained absent in many of the hearings.

If advocate remains absent on 26.07.2018, does the decree will be on hold??
Vijay Raj Mahajan (Expert) 20 July 2018
No hold by court after dictation given, printout taken out, checked and signed by the presiding judge of the Family Court.
Court is not bound by any lawyer's presence or absence if ever decision taken by it.
No lawyer is above the court.
