My wife has filed complaint against me u/s 494 in 2016. I have a girlfriend but we have not married neither we have prepared any document or certificate for it. My wife has never appeared in court till date for this case. We are living separately. I am living alone right now. It is very difficult to get leave and attend court dates. My wife has also changed her address to prevent notice being served to her. Her intention is to make me run to the court now and then. My lawyer is not guiding me properly. How can i tackle this matter?

Better seek reconciliation with your wife thro respected seniors and elders of both the families and settle with your wife and lead a peaceful and pleasant life.

Your advocate not guiding you properly than discontinue his services and engage another one.
As far prosecution u/s 494 IPC complaint case filled by your wife started only sufficient evidence exists on record along with the complaint that summon were issued to you by the Judicial Magistrate after examining the pre-summoning evidence.
The evidence of the complainant has to be recorded before charging you therefore unless that is done your getting discharged of the complaint u/s 494 IPC will not be possible.
The wife is not appearing for recording her evidence than lodge protest with the Judicial Magistrate about it, the last opportunity should be given and mentioned in the order of the day before the Judicial Magistrate can close the prosecution evidence for charging you.
Unless this process is complete you will have to appear in the criminal proceedings or seek personal exemption from personal appearance from the court. All this your advocate is supposed to tell you and guide you and if he's not doing it than he's hopeless person.

Mr.Vijay Raj Mahajan if at all you have any thing to advise to the Querist post it since you are here you have no rights to comment and accuse other Advocates as hopeless person which obviously proves your inabilities and sadist mentalities.

Only a quack can be expected to declare other quack as a good lawyers, who is not guiding you properly. When you have already stated that his lawyer is not guiding you properly, comments against Shri Vijay Raj Mahajan's advice were not justified on the part of the so called fake expert, more particularly, when he himself has not seen the actions of other lawyer before declaring him as a good advocate..

Certainly change the lawyer when you don't have much confidence.When you already hired the lawyer may be in a position to hire the legal services from other lawyer then why questioning the forum lawyers?
