Adoption under hama for foreigners

Hello,

I and my wife are british citizens holding OCI(Overseas Citizen of India) card .WeI have registered with CARA as OCIs living in India, completed the Home study and are on the waiting list for a child for adoption.

Meanwhile a couple known to us want to give up their child for adoption. Can we legally adopt the child? Will it be under Hindu Adoption and Maintenance Act? (I and my wife are both Hindus and do not have any child.)

In case it is possible to adopt under HAMA then will be able to get the NOC from CARA and the 'Hague Convention adoption certificate' which will be required by us to get the child to UK.

14.Non-Resident Indian to be treated at par with resident Indian-
Non-resident Indian prospective adoptive parents shall be treated at par with Indians living in India in terms of priority for adoption of Indian orphan, abandoned or surrendered children. Please click the following link for further information.

You can adopt a child. After completion of adoption by customs and rites, you may register the deed of adoption. but the registration of Adoption is optional. if wish to register the adoption, the biological parents and adoptive parents shall attend before the Sub Registrar where the parents (either biological or adoptive) residing.
