Pay protection regarding

Sir,
My name is shajumon ss have been completed 17 years of service in CISF on a post of constabe/fire under(MHA) .I was applied for the post of fireman II at a wage scale of 8400/- through proper channel my application for the new post forwarded to COCHIN SHIPYARD LTD .After got the appointment letter my resignation has been accepted Technically and joined in CSL as on 03/11/2016 on a pay scale of 8400/. When I am applied for the post my basic pay in CISF was 12300(inluding 2400 GP).After the pay fixation of Central government employees my basic pay was fixed into 33300/- that I am drawn for the month of OCT-2016 from CISF. The new firm is not providing any pension scheme. So the terminary benefits and pro-rata pension process is under progress.
So please suggest me sir whether I am eligible to avail pay protection from the new job.If I am eligible what will be my new scale,and what is procedure ?.

If you applied your new current job by formally applying for it in your old organization through proper channel and technically resigned with lien etc you are entitled to full pay protection.in your current job.

Please tell CSL offered what (i) pay and (ii) pay-scale to you on 3.11.2016 when you joined it.
What is the revised pay scale from 1.1.2017 after implementation of Thirld Pay Committee Recommendations applicable to the PSUs.

Sir Iam so thankful to Ms.Uhsha Kapoor and Mr.Ramachandran for answering my query.The CSL offered a pay scale of 8400-16200 in my offer letter when I am joined at CSL as on 03/11/2016 and my staring basic pay was 8400/- . The LONG TERM SETTLEMENT (LTS) for work man was due in 01/04/2016, the discussion is under progress with the union leaders and the management is under progress.so the new scale is not implemented.

As you technically resigned and lien is available in your parent organisation, you are eligible for pay protection and old pension.
But the thing is that you may have to struggle to make your personnel branch (HR) to understand or to accept it.

Please note your link with your previous employer is already over. That's why you will be getting pro-rata pension for the services rendered with your previous employer.s
there will be no pay protection. You will get what has been promised to you by your new employer CSL.

Sir, there is no pension scheme on the pattern of CCS Pension rules 1972 exists in COCHIN SHIPYARD LTD. So I am eligible to drawn the Pro-rata pension for the service rendered by me in my previous employer.Sir please refer the O.M. No.3379-E.III (B)/65 dated the 17-6-1965, and proviso to FR 22-B. In CSL my colleagues (officers) availed the pay protection who has come from Navy and other PSU'S.So whether I am to get pay protection from the same firm.

In cases of appointment of a Government servant to another post in Government on acceptance of technical resignation, the protection of pay is given in terms of the Ministry of Finance OM No. 3379-EMI (B)/65 dated the 17th June,1965 read with proviso to FR 22-B.
In your case, you are not appointed from one post in Govt. to another post in Govt. But you have been appointed to a PSU. Therefore the question of pay protection does not apply in your case.
The other officers whom you say came from Navy might have bargained about the pay that they will get on coming to CSL (and might have got pay not less than what they were drawing in Navy, but that does not mean it was pay protection). That's why I asked you, what pay the CSL offered to you when you applied for the job.
In any case, what did the CSL say when you asked for pay protection?

Thanks for the valuable advice sir, I understood what you are explained.The CSL offered a pay scale of 8400-16200 in my offer letter when I am joined at CSL as on 03/11/2016 and my staring basic pay was 8400/- .I have not submit the application for pay protection in my office due to the doubt about the rule. Sir, if I submit my request to the CSL for providing pay protection whether they accept my request ?. I am awaiting for your reply sir.

They may accept or they may not. But only then you will come to know what is their stand.
