Section 39 insurance nomination

As per section 39 of Insurance act amendment in 2015

"(8) Subject as aforesaid, where the nominee, or if there are more nominees than one, a nominee or nominees, to whom sub-section (7) applies, die after the person whose life is insured but before the amount secured by the policy is paid, the amount secured by the policy, or so much of the amount secured by the policy as represents the share of the nominee or nominees so dying (as the case may be), shall be payable to the heirs or legal representatives of the nominee or nominees or the holder of a succession certificate, as the case may be, and they shall be beneficially entitled to such amount."

Is it required to produce the Policy holders Succession Certificate or Nominees succession certificate as per the above clause?

If nominee dies before claim becomes due after the death of the insured person certificate of legal heirs issued by the competent authority would be necessary to be produced for lodging claim of the insurance amount.

When you post in new thread with your ID mention if nominee(s) has died before death of policy holder…. Since you have posted mere clause 39 and not the details of the event to the policy…

It is not the job of fake experts like you to analyse the provisions of law. When law is beyond your understanding, why make vague and irrelevant posts just as a matter of playing number game to add scores to your credit? The querist has reproduced the part of the relevant section, but you could not understand what is the provision for nomination and he has to enter in to the fray of claiming the proceeds of the insurance policy.

Even if on your asking the querist posts his ID, what would be your advice, when you have failed even to understand the meaning of the concerned section?

Dear Querist,
Section 39 relates to nomination and the question also relates to the claim by the nominee, so the relevance of the succession certificate is with reference to the deceased nominee, not that of the deceased policy holder.
