Medical Treatment Denied by a responsive doctor

Respected Seniors,

In Hyderabad to day at 2 AM a patient approached M/s Sarada Hospital, it is a registered hospital ( Maintained under Trust ) for severe fever since last 2 days. Where as the duty doctor Dr. Venkat denied for treatment as the time was 2 Am and asked the patient that " What is this time". Finally not given treatment. The patient approached anther nearest hospital and based on seriousness they have admitted the patient.

Now suggest, how to file a complaint and to whom to complaint? Kindly help.

No doubt this negligence of the medical practitioner, but as you don't have any documentary evidence that the medical treatment was refused to your patient nor there was any payment made or promised to be made by you for taking their service, the deficiency of service cannot be pleaded against the person. The taking the matter to District Consumer Forum may not serve any purpose because the said person will always refuse all allegations of not providing medical treatment to the patient, rather some excuse will be made to suit his defence and as you are not having any documentary evidence to prove it not much relief you can except from the forum. The case of Medical negligence is also not made out as that would have been if the treatment given by the doctor and that was not according to diagnosis method.

The Complaint against the medical practitioner can be made to the Medical Council of India for the act of negligence against the person for cancellation of his licence to practise.
