Querist : Anonymous (Querist) 20 November 2017 This query is : Resolved
CAN I WRITE MY PROBLEM TO HIGH COURT JUDGE

ALL OFFIERS ARE NOT RESPONDING FOR MY PROBLEM AND THEY ARE GIVING FALSE ANSWERS
Sudhir Kumar, Advocate (Expert) 21 November 2017
you never described what is your problem and who are the officers not helping you.
Ms.Usha Kapoor (Expert) 21 November 2017
iF IT IS LEGAL PROBLEM YOU CAN POST A LETTER TO CJ OF YOUR STATE AND THE Learned Chief justice may order registering your case and giving your case a number which is called PUBLIC INTEREST LITIGATION. otherwise COURT HAS ITS HANDS FULL WITH ARREARS OF CASES PENDING SINCE A LONG TIME AND IT CAN''T SPARE TIME FOR FRIVOLOUS AND VEXATIOUS CASES.
Ms.Usha Kapoor (Expert) 21 November 2017
Would you mind giving me another like as admin caused me 1 thank loss.?
Sudhir Kumar, Advocate (Expert) 21 November 2017
The querist has not at all given any indication of his grievance being of public interest nature. Thereby it is not possible to agree or disagree with the baove views of Ms Usha Kapoor.

Do you believe that a judge is a complaint officer of your department.

How do you believe that a judge would directly entertain your letter and would intervene without any Officer of some department.
Guest (Expert) 21 November 2017
@ Ms. Usha kapoor,

As you stated, "THE Learned Chief justice may order registering your case and giving your case a number which is called PUBLIC INTEREST LITIGATION," would you please like to confirm whether an individual's personal case can be treated as a Public Interest Litigation?

I shall give you one more "LIKE" if you provide the legal provisions of making an individual interest litigation as a PIL..
Ms.Usha Kapoor (Expert) 21 November 2017
You recall Mr.Justice Bhagavathi's judicial activism didn';t he say a common' man's problem Legal of course can be resolved by writing a letter and post it to the address of CJ of Highcourt or Cj of Supreme court?depending on jurisdiction has become popular since then.
Ms.Usha Kapoor (Expert) 21 November 2017
Justice Bhagwati and VR Krishna Iyer introduced PIL i 192 The person who had IS the Letters/Petitions sent by Common Man/person addressed to Honourable Court, Chief Justice of India, Supreme Court can be reached directly to them or CJ is having time to see the Grievances of Common man. Regarding complaints on Munsiff Magistrate and Judicial First Class Magistrate at District Court and mandals The common man can approach through writing letters to HC, CJ of India. The CJ can look into the matters written by Common man.

Ms. Usha Kappor,

Before Mr Jigyasu reverts back on your reply, I may also say that you being an LLM fellow, I was not expecting your reply like a layman based on some hearsay, borrowed misleading information or contentions of some other individuals as available merely at a thread for some another question at the forum section of LCI. I was expecting some knowledgeable information of an LLM qualified advocate, as may have been based on legal provision that would have classified an individual's personal interest, as the public interest in general.
Guest (Expert) 21 November 2017
Madam Usha Kapoor,

If you carefully see my post, I have not asked who and when PIL was introduced. MY SIMPLE REQUEST WAS to provide some legal provision that treats and individual's interest litigation as a PIL.

In this context, I can simply request you to check for the definition of "PUBLIC INTEREST" as compared to an individuals' interest.

Further, it would be better for you to write on the basis of your own AUTHENTIC knowledge, rather than, ANY hearsay or borrowed misleading information.

CUSTODIAL VIOLENCE AGAINST WOMEN PRISONERS AND GREEN LITIGATION IN India against pollution are some of the examples of PIL;
Sudhir Kumar, Advocate (Expert) 22 November 2017
The ueriest never stated his case to be of custodial violence and he also neve said his case to be against pollution.

If he gives facts the experts may be able to study whether at all he has a case or not, leve aside writing to CJ

@ Ms. Usha Kapoor,
Just posting your response in bits and pieces based on the information gathered from newspapers, which do not have any authenticity/ evidentiary value; beating about the bush can not keep you away from becoming an impersonating expert.
Thanks and Regards

Sometimes, I get surprised, how some people get highly qualified in law, i.e., with degree of LLM, when they prefer to depend mostly upon the hearsay and unauthentic contentions of laymen or news items published in some newspapers.

I asked Ms. Usha Kapoor to refer to some legal provision or authentic knowledge based information in support of her contention. But, evasively some times she refers discussion in query threads of LCI forum on others the articles of newspapers. SHOULD I HAVE TO BELIEVE that she acquired her LLM Degree only through such type of hearsay contentions or the articles of newspapers, not on the basis of the law books.

Even if we believe on the contention of Ms. Usha Kapoor that anybody can write letter with any type of his grievance with any department of the Government of India or States or private bodies, how the skeleton force of the SC would be able to cope with the plethora of such complaints pouring in from throughout India and during which maximum period the complainants can expect to get their complaints redressed, when the Supreme Court, itself has 55,259 cases of the litigants pending hearing as on 01.11.2017, out of which majority of those may be lying pending even from decades back?

Even if it is believed that the 2005 news item of the Times of India is still valid and there exists any such SC Booklet, Ms. Usha Kapoor may like to provide link of the same for access by anyone of us. This may help not only the querist, but also, the experts and other readers.

Despite the fact some of the authors have responded to an anonymous author (including myself), which is beyond rules of this platform even then the stupid and ungrateful author is not expected to submit his "like" or "dislike" in response to social service of experts on this platform.
Sudhir Kumar, Advocate (Expert) 23 November 2017
despite my agreement with Dr Vashista amd Mr Jigyasu, I will observe that the views of Ms Kapoor have been liked by the queriest and thereafter he stopped participating as he got endorsement what he wanted. He perhaps was never interested in correct and complete advise rather just "yes" to his proposal.
