Why u had not intimated about the examination?
Best way to resign from current job and join new organisation.

Dear Ashwini Purohit,

NOC is at the sole discretion of the employer, as you have neither applied through proper channel for the other job, nor intimated about exam within the prescribed time limit to your employer.

Anyway, in which department/ organisation you are employed at present?

If you get the employment in new department, may resign present employment and join new.

Do not hide any information in the new department.

1. Who is your present employer?
2. What for do you need NOC, is it required by the next employer?
3. Do you find next employer/terms and conditions of service better than present?
4. Inform your employer qua your application for next appointment was much before joining present assignment.
5. Discuss with a local lawyer practicing service matters, if your query is realistic and not academic.

i also want to bring to your notice that no induction training provided to me and with lack of knowledge of rules i have not intimated and in good faith shown to prospective employer.
as applied to prospective employer very earlier to present employment

please provide me remedial solution.

i need noc regarding management has not any problem.

As advised above, personally request your AGM, in case of need take help of supervising staff association.

Mr. Ashwani,

You have not replied to my question about the department in which you are working.

However, ignorance of rules is no excuse in service matters. Non-intimation in time is treated as a misconduct in employment, which is subject to disciplinary action.

So, to avoid that all and to get your job accomplished, only submissive personal request to the competent authority can help you. Otherwise, legally you cannot compel the authorities to issue NOC.

ignorance is applicable where knowing the law and then even breaching then it is good to term it as ignorance.
where you have not provided induction training and the same induction training provided to my colleague by personnel dept.

even in terms and condition dos not provided to intimate about the written exams which i filled before the employment.

i am having good faith and i can prove the same too and own my own disclose the same to prospect employer regarding present employment.

as i am not getting any benefit of experience in prospective
employment.

i am very much thankful to experts for giving their time but i am not at all satisfied with the replies by not keeping in reply about the natural law of justice.

where you have not provided opportunity to have knowledge of laws and where as other colleagues got opportunity to learn the laws.

Mr. Ashwani,

It seems you do not need reality based advice, but some feel good vague suggestion, like issue a legal notice then file a case in the competent court against the CMD of the PSU.

If you have not received any induction training, that does not mean that you have become entitled to get NOC for having not apprised about your application to some other organization.

Anyway, if not satisfied, better consult some local lawyer and discuss your problem, if you can get NOC by filing a case, if you feel that the employer is bound to give you NOC.
