Coaching classes are governed under which law

(Querist) 04 April 2016 This query is : Resolved
Request all,
I need a guidance related to Tutorial or Coaching classes which are running without any licence.

There are certain coaching classes in my area, which are running just on Gumasta (shops and establishment) licence basis, they are advertising like they have direct contact with the schools and they can clear all the papers if they took admission in there classes, and all if the student will not take admission so they can fail them.

I want to take some strict action against them but not getting where and to whom i complain even it will be grate help if someone says coaching classes are govern under which law.

please expert need a guidance on this issues.

If indeed they are advertising as stated, you bring the matters to the notice of the school concerned as well the District Officers. However, please note that imparting tuition or conducting a coaching class requires no licence or permission.

I agree with mr. venu.. If the coaching classes are misguiding the people, then you can certainly take an action against them.

I remember when Education Minister Anil Deshmukh was Education Minister of Maharashtra he made some act for tuition classes , It reached High Court , High Court Judge said he never saw such act in life time . What happened next I don't know . But if you are from Maharashtra do revert back will check in Maharashtra Code if that Act still exist and I may forward you copy of that act (Please note if at all it is not repelled then it is applicable only for Maharashtra , don't see for other state , it will totally mislead you)

How are you effected?

You can proceed against misleading ads.
Hemant Agarwal (Expert) 07 April 2016
1. Presently there is no law, that regulates Coaching /Tuition classes.

2. HOWEVER, private criminal complaints can be filed in a local magistrates court, against false /misleading advertisements, under Cheating, Misrepresentation, Breach, Extortion ....

3. Complaints also can be filed before the MET Dept., for false /misleading advertisements.

4. Complaints also can be filed before the local Consumer Court, for false /misleading promises and losses incurred.

Keep Smiling .... Hemant Agarwal
