Accused under 498a whether eligible for govt job?

(Querist) 21 October 2013 This query is : Resolved
Hello Experts

I am one of the accused under 498a which is filed by my sister in law (bhabi).

I am dying to know whether i am eligible for getting job in government sector or not, few people told me that i am not eligible as i am accused under this 498a which is a criminal offence.

My sister in law filed this false 498a case last year.

Thanks

yes you are eligible for govt job .

If the said criminal case ends in your acquittal YOU stand a better chance of getting government Jobs unless, the Government Service rules provide otherwise.

98%of 498A cases are false . it would take years before case is disposed of .

you are not the prime/principal accused of 498A, so, do not worry.

continuing to above question i have one more doubt, what if I convicted by lower court and acquited in high court, till what time i will be consider as accused.

Till the High Court proceedings resulting in the verdict of your acquittal- you'd be considered as accused. The High court proceedings are a continuation of your earlier trial court proceedings. Please click the thank you button on my profile if you wish to thank me for this reply.

Convicted by lower court you are accused / criminally punished till acquitted by the appellate court.
Sudhir Kumar, Advocate (Expert) 23 October 2013
It is irrelevant if you are prime accused or not.

IT IS SUFFICIENT YOU ARE ACCUSED

It is irrelevant if charges are true or not

IT IS SUFFICIENT YOU ARE ACCUSED

Duration of the case is also not relevant.

The fact is that you are not eligible to join till acquitted and that too on merits (not mere technical ground)

hi expert

My bhabhi has filed this 498a case in her home town and I heard that if it is filed in your place means where u r staying than its difficult Becaz they will search the records of near police staion where i am staying.

Wheter the near police station maintain any file/record of such case which filed in different place but accused staying in that place.

I got AB from her home town only.
Sudhir Kumar, Advocate (Expert) 24 October 2013
Do not think that the police administration running since 180 is such a fool. Also do not believe that you are the first person they are dealing.

Be sure your area police station has knowledge of you being accused in XYZ thana.

Further be sure that on selection you have to fill attestation form where a specific question will be there where you have to inform whether any criminal case is pending and if so details thereof and tht whether you are or had been on bail.

Can you afford to tell lie.
