Force Full possession by daughter

. My daughter has taken a forceful possession last year aug 2008 in my property and had filled a suit for permanent injunction



2. In May 2009 I came to know that after getting injunction from Distt Court my daughter is willing to sell out / hand over my flat which is under my daughter possession after that I had also filled a suit for injunction in District Court (Patiala House) not sale / transfer the said flat.



3. My father had made a Will ( Registered at Vikas Sadan ,New Delhi ) in favor of me and my wife’s name before his death and also excluded my daughter in his property .Later we got mutation from MCD.



4, I am going to file a Suit for Possession .What Else we can do .How Long will it took .Does my daughter had any title under Hindu Marriage Succession act in my property.

Mr. Bhupinder singh,
You have allready filed civil suit for injunction.I think your advocate pleaded all facts in said suit.
Your daughter also filed civil suit against you.have appeared in said suit & filed your written statment and pleaded all facts.
All above suits takes long time.Have a faith in your advocate.Law will take its own time.Don't loose confidence, you will gate justice.

Bhupinder Singh Ji! I have full sympathy with you. So far as title is concerned, it is entirely with you and it shall not pass on to your daughter during your life time without your consent. She is not owner of your property forcefully possessed by her so she cannot duly sale it. So far time is concerned, being senior citizen, you can pray before the concerned court on each occassion, definitely it shall be considered and short dates shall be given, but so far force of law in favour of senior citizen is concerned, it is still not available. The legal battle on your part is going on in right direction.

Dear Bhupender Singh Ji - you have taken correct legal steps - Your stand is correct - Your daughter can not claim any right on the proerty durign your life time - your advocate will try to dispose your case as early as possible !

The daughter is taking advantage of the old age of the father and also taking the advantage of Court procedural delay in disposing the Cases
