Change of religion after marriage

Querist : Anonymous (Querist) 28 January 2012 This query is : Resolved
We are a christian couple married for the last 6 yrs. I have couple of questions here. Can either of us get change our religion to islam? and what are the legal formalities for that. If if either of us do change the religion to Islam what happens to this marriage? Does the other partner automatically become a Muslim?
Raj Kumar Makkad (Expert) 29 January 2012
If either of you change religion then there shall not be any impact over your marriage and it may continue subject to your own understanding. change of religion by one spouse is not change for other as it may continue to remain in the same religion.
V R SHROFF (Expert) 29 January 2012
Other partner do not automatically become a Muslim. Religion is a faith. One cannot compel, can not automatically change other's Religion.

Marriage will continue.
Colorful conversions also not allowed.

Hindu male changing religion to remarry, only for benefit of multi-wife, is colorful conversion, is illegal.
Motive of change of religion must be honest and clear.

India is a secular State, and a Secular is not a licence to break the marriage.

Any or both of you can change to adopt other religion.

If both of you change then there shall be no impact on marriage.

If one of you change then it can afford a ground of divorce to other.

But why not back to original home!!!.

I want to change my religion to Islam although i do not have my partners support in this. I assume I will be able to convince later on while i practice my adopted religion. while there will be no impact in the marriage and we both can continue practicing our own religion is it legally correct and valid in the eyes of law? what are the legal steps involved in this change of religion? Does it have to be done via government notification or through a local mosque guidance? e

If your real intention of changing religion (which is obvious ?) is to facilitate multiple partners, it would amount to be a colourable and questionable conversion as has rightly been advised by Mr.Shroff and Mr.Prabhakar Singh. In that event, your present wife will get a reasonable ground for seeking divorce from you.

For the procedures/steps for changing religion, perhaps you may have to seek guidance from the Religious Leaders of the religion concerned.

You have very well been advised that legally there is no problem in your ongoing married life by change of your religion.
Sudhir Kumar, Advocate (Expert) 29 January 2012
If one spouce changes religion the other has option to exrcised within reasonable time to walk out ofthe marraige and get divorce. If the lapse is condoned then the said right goes and cannot be used as trump card for all times to come.

But what Mr Jose said is also relevant.

i appreciate all of u and ur advise. Please note that my intention to convert to islam is due to the influence i had during my stay in saudi for the last 11 months. However since my wife is not supportive of thisand neither will she divorce me since she loves me very much. I have lived all my life as a christian and all my documents are as per my existing name and position. If i change my religion i dont want to get into any legal hassles whereby i may be denied of my rights as the same person of a diff caste..

Apostasy is a ground for divorce in almost all religions.
