Ancestral Property in my fathers name would go to my daughte

(Querist) 18 June 2009 This query is : Resolved 
I am a Christian.My wife I were separated for 2years.Jan'09 she filed dowry harassment against me and family.We have one daughter.I have no property in my name.If I go for divorce,any share in my father's property will go to my daughter. My father's got this property through my grandfather's by WILL.
Please Advise.

Legal heirs will receive their proportionate share .

Your father got property by will (and not by succession). The status of property in your fathers hand is as self acquired property and not as ancestral property. You or your wife or your daughter has no right in your fathers property if your father is alive. If father is not alive, The property will go either as per his WILL or as per your personal laws.
