regarding the highcourt or supremecourt

hello all respected experts,
my matter is that applicant lady got passed the maintanace order in 2003 but till todya her husband not a paid a single pie.applicant lady has a son who studies in the primary.lady lives in the gujarat state and opponent lives at mumbai thane two times in different case warrant issued u/s 125[3] of crpc and done panchanama by police but no any property found of the opponent name afterwards arrest warrant issued for the sending that fellow into the jail but police remarks on the warrant that opponent does not leave there as per the saying of opponent's father in the practical reality is that the opponent live there but he pays to the police so police do not arrest him practical way being a lawyer i also went there then also police did not given support to me and dont serve the warrant can i take any action against the police can i move any writ against the police i would like to prefer writ if any remedy is there plese infore me thanking u in advance

Sure. You should apply to the Court to issue notice to the concerned police officer to show cause why action of contempt should not be taken against him.

In two cases of cheque dishonour, I was succefful in pursuing the JMFC to issue such a notice and summon were magically served.

You may also get the order passed from the Court to serve the summon through a special local (Gujarat) police officer of your choice so that he do not succumb to the lure of Opponent.

In the alternative, you may move to the high court praying for appropriate writ, order or direction in case the JMFC fails to pass such order(s).

You may file a writ petition before the high court against the police authorities for the execution of warrants.

Rightly suggested by my ld. friends. I agree with them. Move an application in the court to stop the salary payment of concerned SHO as he has not made the compliance of court orders.
