(Querist) 12 September 2011 This query is : Resolved
Dear Experts,

one of my neighbour telephonically lodged a complaint tp police station of noise and disturbaance from my flat at night around 11 PM.

We came late from a tour and were having discussions and dinner at that time and some of our relatives and gusets were also presnt at that time for dinner.

Police came and they said we have a complaint against you for disturbance ad noise. but on talking to them they said they were also standing outside from 10 mnutes and it aws quite and were normal noises from the house but nothing serious found andthey went back.

now can i give a notice for seeking compensation for causing mental agony and harassment for making false complaint and a civil suit for compensation against my neighbour.

Please provide the format of notice for seeking compensation for causing mental agony and harassment for making false complaint.

kindly advise

dont make a mountain out of mole hill . just because your neighbour has lodged a telephonic complaint against you for noise disturbance dsoent mean you have to take him to the cleaners .

you have to maintain relations with your neighbours . please note that if you file a frivolous suit for damages it may take 20 years for a result if you are in bombay . forget issue of leagl notice . learn to live in peace with your neighbours

learn to live in peace with your neighbours...this is what i want to make him learn.

This is not a daily practice in any bodies house.neighbour made mountain out of mole hill. it was a quite dinner with no music nothing.

He is eccentric and quarrels with all neighbors on small issues.Everybody in the society is pissed off on him.

Mr.ajay sethi...kindly see urself in a situation where you have some esteemed guests and relatives at ur place having dinner and the police people comes for not much of a reason and saying we have a complaint against you and the neighbour comes and fights with you in fron of guests and relatives.

There are ways where neighbour could have come and told me personally what exact problem is he facing from my house.

Please provide legal advise not personal advise..what legally can be done for for seeking compensation for causing mental agony and harassment for making false complaint.

Please experts

you wan to file suit for damages go ahead after issue of legal notice . you will have to engage a lawyer and pay court fees on amount claimed by you as damages .

So you yourself have come against, ruin your time also then, and why only that, money also.

I feel you can lodge a private complaint for defamation against your neighbours..
Rajat sahotra (Querist) 12 September 2011
no need to engage a lawyer and pay I got one in family.
Compensation amount claimed can be merely 10000/- and may be much low and so will be the court fee.

its going to be he neighbour paying to lawyer and facing harrassment to come to court wait long hours for hearing of his case for 20 years as Mr Ajay said for making mountain out of mole hill .

It is also a option to lodge a private complaint for defamation against my neighbours..

thank u all for advise.

You are lucky, then have good going.

We experts should confine only up to legal replies and not personal suggestions untill those are specifically requested.

You can go for civil suit seeking compensation as desired. Court fee is required to be affixed even on the claim of Rs. 10,000/- as asked by you.
