High court response

Respected Lawyers,

If I apply for quashing of a case running in a lower court before the high court, what are the chances that the high court may create new problems for me instead of giving me relief?

I want to apply before the high court for quashing of a case but at no cost want the high court create new pains for me.

Q1. Can an applicant file further evidence in a case at the stage of argument even if the opposite party objects?

Q2. Can an application for quash be presented before high court for a case at argument stage in a lower court?

My ex-wife filed a case against me in 2012 complaining that my family members and me did not return her stridhan and other items she demanded for at our main house. She has retained her words in her cross also.

She has produced a paper on which details are that some of the items she is taking with her to her parental house and some of them like jewellery given by us and furniture items are lying with us in our main house. This paper is signed by 6 people, three of us and three of them including she and me on 23.5.2010

When she moved to a rental house with me in July 2010 she and me signed a paper on which it is written that all the items except 2 suits and a briefcase have been received in the rental house on 27.7.2010. She and me both signed it.

Then in April 2011 during her cross examination in the case u/s 125 she accepted before the court that " मैंने अपने वाद पत्र व शपथ पत्र में नहीं छुपाया है कि मैंने मई 2010 के बाद अपना सारा सामान प्राप्त करके अपने पति के साथ अलग रहना शुरू कर दिया था। ये सभी बातें मेरे वाद व शपथ पत्र में शामिल हैं।

In original complaint in 2012 she wrote that she demanded her materials from all of us at our main house which we refused to return.

Can you please throw some light on the possible outcome of the case keeping in view the above points. In fact this is a false case on me just to blackmail me and snatch money from me.

Thanks for your precious time and energy. Thanks a lot.

My ex-wife filed a case u/s 498A, 323, 506 and two more sections. I was acquitted from this case for absence of evidence. I was freed in 2015. Case was filed in 2010. She has taken one sided divorce from me in 2014.

Simultaneously she filed a complaint case with ACJM through application in 2011. This case is still running. The problem is that she has taken all stridhan, furniture and all other marriage stuff with her at the time she left our home but we don't have any evidence of it. The whole case has run and she is the only person from her side who has given statements before court and got crossed. I don't think we have proved her a liar in her statements and during cross. She has very cleverly defended her statements. She has provided a list of items to the court and their bills. There is no other evidence with her but her statements, list of items she has already taken with her and their bills. I'm looking for the opinions of great lawyers of India to please give me a glimpse of what I must expect out of this case since the case is about to conclude and I'm tensed for the results.

Please someone guide me. I shall be grateful. Love and respect to you all.

Many years ago my ex wife filed a false case against me and my parents undr secs 498A, 323, 506 373 and some more secs i dont remember now. The hon'ble judge didnot find any evidence and I was awarded the case in 2015. She also took one sided divorce from me which i came to know of many months later. She remarried and there also she has filed a case u/s 125 for maintenance and that marriage is also about to dissolve.

The problem is that this lady has filed a case against me u/s 406 for recovery of stridhan which this clever lady has already taken with her. I dont have any evidence of it but this dirty minded lady has already taken everything with her while she started living with her parents and now she is trying to use sec 406 to blackmail me for money. I am badly frustrated because this complaint case is running from 2011. I am getting harrassed for a very long time and for having done nothing. Can somebody advise me something?? I am under depression because of this case. This lady is harrassing me for a very long time.

My Grandmother Signed a Blank Paper

Sirs & Madams,

My grandmother lives separately in her house in Delhi. She has great properties in her name (house and other properties) both in Delhi and in other states. About a week ago a man visited her in civil dress. He told her that he was a policeman from a police station in Delhi. He told her false stories and, in a fraudulent way, got her signatures on a blank sheet of paper. My grandmother is an illiterate woman and is very old. We're seeing that a fraudulent activity like an attempt to transfer her properties misusing that paper can occur in future. So, we want to take all necessary actions required in this case. Please advise:

1. What can be the possible misuses of the paper?

2. What kind of actions we can take to nullify that blankly signed paper. It was not a stamp paper but a white sheet of paper. We want to take all necessary legal actions and want to nullify that paper immediately. Please Advise.

Pls advise how can i save myself

Dear sirs/madams,
My wife has just registered an fir u/ss 498A, 323 and 506 of IPC and u/s 3 and 4 of DP Act. I've never beaten her and I've never put her to any kind of mental pressures knowingly. Nothing such has happened between us which can easily be treated as cruelty. Moreover, I've never demanded and taken any dowry. I never threatened her in any way. Actually she is doing this just to teach lessons to me and to my parents because I donot obey all her orders. She has always told me that I and my parents have to keep her happy in any way because if she would use the law of India there will be nobody who can save us. And she did the same thing. Is there anybody in this world who can please tell me about the way out???

registration of hindu marriage

Sirs,

It is being said that registration of marriages is now compulsory and once registered it is binding on both parties. But if marriage took place 11 months ago and not registered yet, can it's validity be challenged?? Isn't it legally acceptable??

right of bride on the property of father in law

Sirs,

I've a dispute with my wife and she is living separately from me. I'm ready to pay her maintenance and alimony if ordered by the court. But the girl wants to eat my father's hardened property. Is there any law under which she can claim her right in my father's property against my father's will. My father has already debarred both of us from all his movable and immovable properties and has severed all his relations with us (through an advertisement in a national level newspaper). Is there any chance available with the girl for doing this. Pls through some light.
