if i m an advocate then can i do practicing as a trademark agent without any proceeding to becoming an agent. and it is necessary to become a trademark agent if i m an advocate.

Suppose i am assigining our registered trade mark to be used by one of our group company. Is the agreement required to be registered? Kindly give some detail idea as what to do in this regard in excess of drafting the agreement.

We have a trade mark registered in India under the trade mark act 1999. The said mark is used by a US based Company to who are using the website domain name www.xyz.com which is same as ours. Can we send the US Company a notice to cease and desist in view of our Registration of the Trade Mark in India.

theres a swiss company which has licensed the trademark and permitted the use to an indian company.
so does it needs to register in india also, what protection does it enjoy,,,, what section of trade marks act 1999?

First Sec.138 of NI Act notice issued against Mr. B. Thereafter, Mr. B called for settlement and asked to wait for 15 days.
Now, Mr. B denied for settlement, S. 138 notice period passed by 40 day...
Can second time notice U/sec. 138 of NI Act is permissible or what would be a remedy for this?

Can suit be stayed
One "X" company filed a trademark suit against me. I have filed before Intellectual Property Board that i am prior user and having documents to that effect.
I have also filed a detailed written statement in the suit.
Case not listed before Intellectual Property Board. But District Judge has made the case in trial- special list.
Can the suit be stayed till the order from Intellectual Property Board?
