Divorce

This is the case of my relative, the consequence of facts are :
• Wife leave matrimonial home.
• Husband file RCR.
• In reply of RCR wife state that she wants to live with her husband but it is not possible for her to stay where in laws reside.
• Husband withdraw RCR.
• Wife file maintenance case u/s 125 CRPC.
• Husband mail letters to wife requesting to come and stay in his family.
• Wife did not responds to any letters.
• Husband file petition for divorce on ground of cruelty.
• Wife is ready to live in the family of husband.
• Wife did not want mutual divorce.
• Due to bitter relationship for more than four years, and as wife files maintenance case and false execution case against husband, husband and his family memberes refuse to accapt wife.

What is the possibility of DIVORCE ?

Hindu customary law

Dear sir the property is in Pondicherry its is my grand grand father property.he got the property by a gift feed from his father.he died in 1961 leaving the property intestate. There are two daughter and son to my grand grand father.my grandma was taking care of some of the property since his demises.she wrote a will for my mother to enjoy the share of her property as she is entitled to 1/3rd of her property.now my grandma brother(expired)wife has come and taken the possession after 44 years of my grand grandfather property and she telling Hindu customary law ,they are true owners.plz guide us whether shall I proceed to file a suit and is there any provisions in my favor in Hindu customary law

Fulfilling the eligibility requirements

One of the CPSE has advertised the following Eligibility Requirements with regards to Post Qualification Experience as on 30.11.2015:


"Officers working in Central/ State Govt./ PSU/ Autonomous bodies with minimum 10 years of Post qualification experience in relevant field in the Executive grade (E-0) of IDA pay scale of Rs.12600-32500 & above out of which 3 years should be in the IDA pay scale of Rs.20600-46500 or equivalent with CTC of Rs. 8.00 lacs per annum working in a reputed private organization"

I belong from a Private Sector Employee and I have got a total work Experience of 16 Years till 07.08.2015 and my current CTC is Rs. 15.00 Lacs and the requirement of CTC of Rs. 8.00 Lacs is getting fulfilled by me for the Past more than 05 Years (i.e. April 2009 onwards).

Under the circumstances, am I eligible to put forward my candidature for the aforementioned posts or not? I already qualify with regards to the prescribed educational qualification requirement.

Please advise on priority.

Disqualification of arbitrator

Dear Experts,

This is a unique case.

Arbitrator is the father of partners "A" & "B" who are running a partnership firm. The Arbitrator is the named Arbitrator in the partnership deed.

"A" is disgruntled with the Arbitrator over previous Awards. With mischievous intent "A" files criminal charges in a Magistrate's Court after passage of an Award.

Now after about 18 months the magistrate frames charges and starts trial.

During this process "B" has filed one more Arbitration appeal with the Arbitrator. "A" has acknowledged the appeal & Arbitrator and has attended all the proceedings and submitted his reply to the Arbitrator.

Now "A" has realized that he is not going win Award in his favor. He writes to the Arbitrator as says that Arbitrator is disqualified as there are criminal charges framed against him.

Should the Arbitrator resign?

If the Arbitrator refuses to resign & proceeds and passes an Award, will this Award be disqualified u/s 34, on the grounds that Arbitrator has misconducted himself?

Please advise.

Purchased Navin shart land

Dear SIR
I purchased land of b2 navin shart ..and make reg agreement deed not sale deed..
But make a notorised sale deed..the seller give me full possession
I submitted a documents to collecter to give me Permission to purchase a plot about 4 years ago
But the problem is that i Constructed a building on 2 years ago (waited for permission,but not get the permission till now) that land..my question is that am i make any shart bhang ?
I filled Muncipal carporation tax and they are giveing tax slip of my name of that bulding...i costructed that buliding according to Muncipal norms...
Seller gives me open plot.
O shall pay amount of open plot or amount of open plot + building amount premium..to collecter or gov to get permission and make a sale deed

Legal Heir from tehsildar or municipal corporation

My boss has taken a flat and he is died last month... Some amount is balance to pay for the builder. But no nominee is mentioned. Now his wife want to pay balance amount and want to register flat on her name.. Is the legal heir issued by tehsildar accepted or not

Reg a property dispute!!

My mother owns a property of 98 cents in kerala, which was till date unknown to her or us till now when we received the will.

by the time we came to know this a builder had already forged some doccuments, constructed villas in this property and also has sold some of them without any of our knowledge or even consulting us..

We dont know what to do to get back the property for which the Original deed/ will doccument lies with us. We have no possession certificate nor any land tax receipts paid as we didnt pay anything and presume that the builder may have paid the same with the forged doccuments.

We have filed a case against the builder in the land tribunal. How do we proceed to prove that the property indeed belongs to my mother and no one else?

Need your suggestions / advices immediately on this.

House regarding

My father owened a tanament house in Vadodara, he expired on may-2015, he gave my name as sole nominee in housing socity.
I do have a sister who is married and my mother expired in 2008.
My question is 1) how to transfer the house in my name. 2) do I have to pay stremp duty for it? 3) can my sister ask for share in this house?
