IPC 306 and some case laws

Dear sir,








My sis has got married in 2002,with a person who was in the profesion of civil contractor,









there marriage was registered marriage,after 2004 . They had bought one house which they have bought on the name of my sis. After some days we came to know that her husband is habitual drunker and having all other bad habits.









The situation of there profession become worst,they left the civil contract,joind people like playing gambling,drinking and all bad habits..After a period of 4/5 months there was daily disputes/quarrel between husband and wife,because of money and his habit of drinking.matter gose to police when his position become week they tried to get that house by every week coming to us for compromise and they saw when it was not possible her husband started hitting her everyday ,threatening us every day for that house,through other persons,where we were not concern with that house. . We have lodged so many police complaint against him for violence and asking her to left the home,but it is of no use









Inlaws of sister filed case in civil court to get/claim that house ,there relation gets spoiled and situation become worst day by day.









Meanwhile the case of civil court was in our favour,because he has been asked so many question during cross and argument he replid and agree that I have bitten my wife,used abusive language to her,I am habitual drinkerand threaten her parents,brothers.They have brought stay on the sell of house which is in the name of my sister.









Now they are staying separate since last 2 years,because of day to day quarrel and his violence,and threating her with dire consequence.









One day we heard his husband commited sucide by consuming poision.Inlaws filed complaint against my sis and parents that they have police lodge complaint against sister and other family member that they have threaten him for the house own by sister and lodged complaint under s/c.306 of IPC









Please suggest what to do,









We have taken bail and the case is in session court.can we make an application for dismiss the case because it is false case.









Can you please give any case laws on IPC-306 on the ----

How to disown an adult child??

I hve a friend who is Psychic in nature......He used to talk about aliens, says he has execptional powers to know in advance the future and also claims to hve known various aftermaths in advance dat happened reently (fool and psychic).



He sits at home, do nothing and used to harshly beat his father who runs an ailing business and his sister who works day and night........make big talks and do nothing but abuse them and beat them.........



they hve got enough of it and now wants to disown him.........



they tried to send him to the mental hospital but it says that he first has to be brought to the hospital which is in no way possible as his father is too old to control him and a sister only.........



police is also several times reported but it comes at home, say him a word or two and goes........which don't hve any affect and he do everything with impunity.........



kud u pls tell me the procedure to dis-own him without any long legal hassels and the rights getting vested with the family thereof........



and also any way if not above, how to sent him to the mental asylum,



pls help.....

Subsequent pleading under Order 8 Rule 9 of Civil Proc. Code

As per this provision of Order 8 Rule 9 of C.P.Code subsequent pleadings regarding Set-Off or Counter Claim can be filed without the leave of the Court.Other pleadings do require leave of the Court. I could not find any direct Judgement on this point either of Supreme Court or any recent High Court Judgement. If any Lawyer or Expert find any judgement directly on this point, reply may be posted on this column.Thanks.

Limit on Gratuity

I heard that the life-time limit / ceiling for Gratuity has
been raised from Rs.3,50,000 to Rs.10,00,000.

Why should we pay bonus,gratuity, leaves, notice pay to daily wage workers.

Dear Mr. Harbhajan.
I have come across one issue. We have a branch in Neiveli ( chennai)where we are working for BHEL company. We have hired 25 workers on daily wage and 2 on monthly. Those who are on daily wages are under Neiveli labour License purview.
Now some workers are doing some agitations. But our representative who is on monthly rolls insisting on unofficial negotiations for Full and Final Settlements as we wanted to remove 4 daily wage workers.
Here important issue that even though they are under daily wage, we are paying monthly once in to their bank accounts (no. of days worked * daily wage)..hence it is not a salary but a wage.

Now, it seems local trade union met chennai asst labour commissioner and unauthorizedly made the following issues to follow if we need to remove. Here I have a doubt..whether are they really come under law ? or simply that Labour Commissioner supporting these union ?
Can we oppose this ?

Those points are :
1. we should pay 20 days' leave wages for every 240 days completed.

2. We should pay 15 days pay for every 240 days completed. ( might be gratuity).

3. We should pay Conveyance allowance of Rs. 200 every month for the service they have completed.

4. We should give either one month notice or pay 26 days notice pay amount now itself.

Here we can assume that they have joined on 1.12.06 and working till now.

I have a doubt, if these are daily labour why should we pay bonus, gratuity, leaves salary, conveyance ( no law), and notice pay..?
How to go for argument with that Chennai Labour Commissioner in this regard and how can we support this ?
