Require Help

A was sentenced to rigorous imprisonment for two months for a criminal offence. After the expiry of the period of the sentence, he filed an appeal against his conviction and sentence and prayed for the condonation of delay on the ground of imprisonment. Will the court be justified in extending the period of limitation in this case?

Re: Stamp duty on shares holding in joint name transfer to spouse

I have been informed by a company that stamp duty I chargeable for share transfer of spouse already shares are in joint name. Is it so? Since Deemat account of single person does not allow joint shareholdings it is necessary to make it single for joint holding by spouse in the single name. But it is not sale or transfer in literary sense than why stamp duty on market rates of shares is Levi able? Even if it is so it should be for 50% (half the value) of total market value as spouse is having 50% share in it. Will the authorities or a competent person clarify it? In my view there should not be any stamp duty on such transfers’. And if it is not the law such an amendment is a must in public interest.
In fact, in all family settlements under all tax laws there is no stamp duty, as no transfer of property actually takes place.
Further I suggest that all family (blood relations) transaction of transfers/settlement / and even sales if any including shares should be exempt from the provisions of Stamp Duty Act.

BOMBAY VILLAGE PANCHAYAT ACT 1958

Can the gram panchayat has a power to give/grant building permission (under which act & section)?

There is a Maharashtra regional Town Planning act 1966 is in existance in the district, but in some areas of the same district(villages) there are no nagarpalika/mahanagarpalika.

Then what is the right & legal authority to take a building permission falling in village?
A) Gram Panchayat (sarpanch / gram sevak)
B) Town planning authority

Higher studies in law

Dear Sir,

I completed law in 2007. and want to study further. right now I am working with chemical co. and currently pursuing PGDBA-HR management, which will be completes in feb-2008.

I want to take admission for higher studies in law from Australia. but I don't know how to take admission and also college.

tresspassing and rental agreement

sir
if someone is residing in a property and no agreement for tenant landlord is made and no rent receipt is there and the person is not vacating the house can house tresspassing will be registered against him
? or the landlord should file eviction petition in rent tribunal? what is the best way out and any judgement in relevance to this?

PF Applicability

Dear Members,

I am working with a company where PF is not applicable and company has not applied even after 2 years of its operations. The company has its Corporate Office in New Delhi and they do not have any Factory. The manpower of this company is according to the PF applicablity is over and above 20 since starting it process.

The directors are not interested to introduce PF in the orgn. so Nobody has taken interest to introduce the same.

But I joined this organisation and observed that the PF should be applicable and anytime PF enforcement team can come and see our records. However, the company have employees whose salaries are more than the limit of PF.

May any members advise me how can I go about it.

The matter is urgent pls rush.......

Registration of a Freelance Group

Hello,

I am Mukesh.
I want to register a "Freelance Group", which will take the work assignments from the market and provide the solution to the customer. The work will include Translation of documents (foreign language to English or vice versa), Interpretation, Outsourcing, Tour Escorting, Teaching foreign languages etc.)

Actually, I dont know much about the registration process. I want to register the Group in the name of my Brother. He will be the Owner of the Group and We (experts) will work under this. Would really appreciate if anybody guide me the process of registration and the cost.
