WILL

Querist : Anonymous (Querist) 27 April 2019 This query is : Resolved 
I he made a will few years back and registered it,
After few years my wife divorced me, now I hv to change my Will .
Do I hv to cancel with at registrar's office ?
Or
Can I just pen write a new Will , with two witnesses n Doctors fitness certificate.
Is it require to get involved with Registration process, or just pen written by myself, two witnesses plus Dr certificate will do the needful .
This bcos my ex wife has left me a pauper

Please note that Registration of a Will is not mandatory in law how ever, I would recommend that if you had chosen to register your previous Will ( which is now being revoked ) you should also Register your new Will and codicil and cancel the earlier Registration to avoid complications and hurdles in future.

Dear queriest, Yes. Will registration is not compulsory and the last will whether it is registered or not will come into force. It is better to execute a fresh Will cancelling previous will (separate cancellation will is not necessary, in case you execute a fresh will).

It would be better to get a cancellation deed and fresh "will" registered without any medical certificate if you are in a sound health and deposing mind.
However, consult a local prudent lawyer with relevant documents for better appreciation, guidance and proceeding.
