Registrar of society (maharashtra) - agm

Respected Sir/Madam,

I am from Maharashtra, Mumbai.

My Society had missed two AGM of Sept 2014 and Sept 2015. Even after that Registrar had conducted election in Oct 2016, Committee is re-elected for Second term.

Now They have put three B/S and I/E i.e. 2015-16, 2016-17 and 2017-18 in the coming AGM on 30-09-2018. Can they do it legally?

If yes, under which section? and

If No, under which section they can be penalised or as a member what should I do to stop them such illegal method of practising.

They all are doing it Honorary.

The question of legality not arise because the committee functions are regulated by the bylaws.If at all you have any grievance, you should appeal to the Registrar for intervention.

But my main question "Whether Committee can put three Balance sheet and Audit Report in one Annual General Meeting?"

The pending Audit reports ans imperial statements could be place before the General body irrespective of the years.

Are the committee members have to take any permission from Registrar in writing? Or do they have to just inform the Registrar and conduct the AGM?

Present MC shall have to get the pending accounts approved by AGM.
Registrar Cooperative Societies shall charge penalty for late submissions of accounts.
To improve your legal knowledge qua appropriate provision of law for filing and non filing of balance sheet and accounts of the Society (as inquired in this query) you will have to join some coaching centre, institute, college or university.
