Registering our family owned temple

(Querist) 31 December 2019 This query is : Resolved
HI,
We have a family owned temple which was founded by our great grand fathers. A joint family of 7 grand parents (Two mens and 5 women) founded this temple and start worshiping it for the past 50 years. So this temple belongs to those 7 peoples and their generations. Out of those 7 family, only 2 persons from respective two families took the ownership of governing the temple and organizing the festivals. Now there are many threat started coming from outside of these families. SO now we would like to register the Temple under these 7 people in which 2 persons will continue governing it. We have to include the history of this temple and make it official and ensure that this temple belongs to those 7 families only.
how to proceed with registering the temple.
Is registration in Govt official documents will solve the threat from out side.
Do we need to form a trusty on the temples name
Please suggest.

Note: there is no difference of opinion within these 7 families. The temple is only worshiped by our community and not opened to all. These 7 families every year share some money to conduct the festivals.

Yes. It requires Trust for religious purposes by a certain sect of people. Consult a local CA or a lawyer having knowledge in trust matters.

The temple can be registered under private religious charitable trust.
For forming trust all those seven people's name can be mentioned and a trust can be formed with the existing members
A Private trust may be created for any lawful purpose.
A private trust can be created by any person who is of the age of majority and is of sound mind, and is not disqualified by any law. Every person domiciled in India attains majority, when he or she completes age of 18 years.
. Registration Process of Public Charitable Trust

1. Since the Temple Property, Assets & Liabilities etc.... belong "ONLY" to specific Family, the only type of Trust that be created & managed only by insiders is "Family Trust" and not a "charitable trust of any kind", since outside infusion of funds in any manner will open the doors to others /public scrutiny etc....

2. In a Family Trust, NOBODY else besides the Family members & their legal heirs would be able to manage the Temple Property, Assets & Liabilities etc.... Make relevant & strategic clauses in the Family Trust Deed.

Keep Smiling .... Hemant Agarwal
