19. ADMISSION OF MENTALLY ILL PERSONS UNDER CERTAIN SPECIAL CIRCUMTANCES-

Any mentally ill persons who does not, or is unable to, express his willingness for admission as a voluntary patient, may be admitted and kept as an in-patient in a psychiatric nursing hospital or psychiatric nursing home on an application made in that behalf by a relative or a friend of the mentally ill persons if the medical officers-in-charge is satisfied that in the interest of the mentally ill persons it is necessary so to do:

Sirs/ Ma'am,
For mental cases which is not about the property of the mental man, the first point to go is nearest Police Station. They will prepare the FIR or other documents related to Mental Health Act. No court is going to take cognizance of whether a person is mad, unless his own behaviours and conduct are brought into the scrutiny.
If the police station is not showing interest, go to Supdt of Police. Normally they also be very busy. Next is to file Crl complaint in the Magistrate court, under sec 156(3) and 200 crlpc.
To control the properties of the mental man, to file Civil Suit under Mental Health Act, please note, each and every relative, friend and your enemies will be a defendant; otherwise when the case will be proceeding, one such man will come up with an application under order-1 rule 10 cpc, to delay the justice.
