Can the respondent violate or show disobedience to the interim order issued by honourable single judge of High Court if the the respondent appealed to division bench to suspend the interim order

The respondent cannot either violate or show disobedience,but he can appeal to the division bench against the iterim order of the single judge.

Hi,
Violation or disobedience of even of an interim order is punishable according to what order conveys and how it has been violated.Appeal against such order does not give licence to the violator unless there is a categorical stay of operation of such by higher court.Plz note that language of the order is important to understand the import of it.

1. While granting ad-interim injunction, the Court will mention in the Notice to be issued to the injuncted that he shall have to explain on the next date of hearing (which is normally fixed after just one month) why permanent order of injunction will not be issued on him,

2. On the scheduled date, he can file his objection against the said ad-interim injunction,

3. A date of gearing on the said matter will be fixed by the Court and both the parties will be heard on that day,

4. If the order goes against the injuncted, then he can challenge the permanent injunction before the higher court.
