Hindu Sucession Act

(Querist) 14 August 2009 This query is : Resolved
Dear Mr. Expert

I have a query regarding the captioned act. I want to know if as per Will of my father only my brothers are successors of his property, can I file a suit for inclusion of my name in the property. I'm empowered by the captioned Act to challenge the Will made by my father( expired)??

regards

Dear Amita,

If the property is self acquired property of your father you dont have any rights but if the of the property is ancestral you can claim that property. And also check that ancestral property is already bequethed before Decemebet 2004, the Hindu succession Act, 2005 is invalidated your claiming rights and property rights.

Yes, I also agree with Mr.Desai. If the property is self acquired property of the late father, you will not have any share as per will of the father.
