Filing of non cognize report by neighbour & chapter case

My neighbour stays in adjacent B wing whose back wall connects to Terrace of our Wing. C.

Without proper permission from the Society, he has illegally made entry access to this and uses daily despite objection from the C wing residents.
Since I am more vocal about it, he has filed an NC under false allegation and finally the Police station (Executive Magistrate in the same police station) has filed a case u/s 111 and issued notice of Chapter Case Notice u/s 107. I too had given written explanation against his 1st NC with photos of his illegal access. Further I too filed a written complaint against him twice but nothing moved ahead.

Now with some influence in the Police Station he has managed to get a chapter case registered against me.
The Police tried to dispose this matter by convincing me to sign a BOND but I disagreed and informed that this will be decided by putting my case across and be decided on merit.
But I doubt this will be in my favour because of his influence in the Police Station.

What are my options in this case
Can someone advise how to handle this and if its not in my favor how and where to appeal for justice

The Issue is the neighbour is encroaching the Terrace illegally his content is since the conveyance is not taken by the society the builder has given him the rights of usage. I had sent regd notice about this to builder no reply from him about this.

Since I and other 2 residents are against this usage (this terrace has peeping access to our bedroom, kitchen and drawing room). He is using his clout in police station to harrass us . esp. myself. He has filed 1 NC of the incident of opposition by me and on that basis 3 more NCs were filed in Police station with some clout. Now I have been charged Chapter case

Also wish to understand if I can appeal to higher authority to quash this chapter case and also continous harassment of police and debar the neighbour from filing fresh cases. what are my opitons for the above

As per me the society is not formed and building property in the name of builder and builder has permitted to use then you have less chances against that person. Try to amicably settle the issue. You can consult with local advocate for accurate and further course of action.

The Society formation was done almost 10 years back and this guy had a dispute with builder n matter was in court which they settled out of court. Now since last 6 months he has come to stay and ha created this nuisance.
