First issue notice and terminate licence of that person and than file suit for possession against him.

1. Who is the owner of property? Plaintiff or his father?
2. If plaintiff's father's property, is he alive?
3. If plaintiff's property, on what capacity his father permitted/ licensed the tenant to occupy the property?
4. What are the terms and conditions of tenancy/ occupancy?

After answering these questions, you can come to conclusion.
Think and decide.

Sir plaintiff is the owner of property. His father gave oral permission to defendant to live without rent considering his poorness. Plaintiff was out of city in his job. Now father has died. I have issued notice. But he didn't answer. Now I am unable to find provision.

Whether the notice has been received by the person-in-occupation?
If so, file a suit for possession.
