Employement bond

dear sir,

i joined a company in 15 June 2012 and worked upto 8 september 2012, before joining this firm i was having a experience of one year as marketing engineer related to sales back ground. this company hire me for marketing stated that you have to work for technical marketing & look after of exhibition and marketing activity. but after joining they asking me to work on digital marketing like email & campaign. after joining i signed a bond for 2 year service. but they had not provide me any traning related to my work profile to add something in my profile in between the peroid form june -SEP. in september i resigned from the job as i was feeling that they want to make a tele caller rather than a marketing person they asking to work on digital marketing but not providing any training . after my regination letter they accepted my resignation . i left that job from that onwards. AFTER ONE MONTH OF MY RESIGNATION LETTER& ACCEPTANCE THEY SENT A LETTER FOR PROPER HAND OVER & RELIVING , FOR THAT ALSO I REPLY THAT SAY THAT I AM NOT IN THE CITY WHERE I WORKED WITH THIS COMPANY. SO I AM NOT ABLE TO COME AGIAN TO MUMBAI FORM DELHI. AND NOW THEY ARE SERVING A NOTICE TO ME FOR BREACH OF CONTRACT & ALSO PROCESSED THE CHECK THEY HAVE WITH THE BOND. BECAUSE OF IN SUFFICIENT AMOUNT IN MY ACCOUNT THAT CHECK GOT BOUNCED. I AM SIMPLE GUY DONT LIKE CHEAT PEPOLE . FROM A VERY POOR FAMILY.

PLEASE HELP ON THE SAME ISSUE LOOKING FOR THE GUIDENESS I AM ALSO ATTACHING THE MAIL THEY SENT TO ME please also check the mailer & my regnation acptance in the attachment

Your mail is not found attached here even then it is stated that you shall have to contest the case and shall have to refute the allegation and liability towards you because you had been hired for the marketing job but were not offered that job practically which led you to leave you job so the matter of bond amount is not attached with you.

If company has not fulfilled its commitment and moreover no training has been provided you leading any extra burden over the company then nothing can be got charged from you

You have to contest this matter in court and prove the facts in the court.

AS REGARDS TO CHEQUE YOU DID NOT OWE THEM ANY THING AT DATE YOU HANDED OVER.

WAS IT DATED BY YOU?OR THEY FILLED THE DATE BEFORE GETTING PRESENTED AND GETTING IT BOUNCED.

DID YOUR APPOINTMENT LETTER CLEARLY DEFINED YOUR JOB AND DESIGNATION?

DID THEY RAISE ANY ISSUE OF BOND WHILE ACCEPTING YOUR RESIGNATION?

AND WAS THERE ANY TRAINING PROVIDED TO YOU ON COMPANY'S COST?

WHAT LOSSES THE COMPANY HAS ACTUALLY BORN DUE TO YOUR BREACH ?BOND AMOUNT IS A SUGGESTION THAT COMPANY CAN NOT REALIZE ANY SUM MORE THAN ONE MENTIONED IN THE BOND EVEN IF IT PROVES ACTUAL LOSSES MORE THAN THAT.BUT IF BOND AMOUNT IS ,SAY, 01 LAKH BUT LOSSES PROVED BY IT IN COURT IS SIMPLY 10K THEN COURT SHALL AWARD ONLY 10K AND NOT 01 LAKH AND IN CASES WHERE COMPANY PROVES IT'S LOSS ,SAY ,02LAKH,EVEN THEN COURT SHALL AWARD ONLY 01 LAKH.

SO THESE ARE THE SUGGESTIVE POINTS TO ADDRESS IF ANY CASE IS FILED AGAINST YOU.

sir,
they them self filled the date after my RESIGNATION from the job.they submitted the cheque on 7/feb/2013. i gave resignation on 8 sep 2012

at the time of accepting my resignation they did not rised any question regarding the bond.

regarding training after my induction , they had not provide me any training related to my work profile or to enhance my my knowledge.

sir they are threatening me to file a case against me for bouncing a cheque the same i gave to them. please help for the same.

main thing is your appointment latter's terms and conditions, without the appointment letter, we are unable to give you best of our advise on your matter

Any specific opinion can be formed only after going through the terms of appointment letter, contents of the employment bond and of their notice.
