Can i sale my flat while consumer court proceeding agst builder

(Querist) 14 September 2016 This query is : Resolved
Dear Sir,
I am fighting a case agst builder in the consumer court for last 1 & half year for the delay of possession & poor quality of material used in flat.
However can I sale the flat before closing the case or should I wait till result of the case.
Pl advice.

With Regards,
Santosh
Thane, Maharashtra.
Advocate Bhartesh goyal (Expert) 14 September 2016
Since you are owner of the property and have every right to transfer or alienate the same, beside this, your case against builder is for his deficiency in services and unfair trade practice and not for declaration/title and injuction so alienation or transfer of property during pendency of consumer case will not make any adverse effect on your case.

In addition to the advice of Ld. Bhartesh ji, I add that the subsequent buyer can replace you in the ongoing litigation and further be benefitted in case the complaint becomes successful.

It is good to see that some authors do come back to post their thanks for Experts.
Raj Kumar Makkad (Expert) 15 September 2016
If Doab can come repeatedly to take pain of the authors then the authors are also duty bound to rebut in the same manner.
Rajendra K Goyal (Expert) 19 September 2016
Agree with the expert Advocate Bhartesh goyal.
