Building plan permit given illegally

Hi Sir,
i have ancestral property, after demise of my father it got devolved upon my elder brother and myself.
meanwhile without my consent my elder brother sold away this property in favour of others(X), on knowing the same i filed civil suit against both of them, and informed the same to the municipal authorities in written, as things stood thus municipal authorities in collusion with other(X) stake holders for their selfless ends accorded building plan permit to X.

whether the permission accorded during pendancy of suit is valid in law?
after proper intimation to municipal authorities their accorded building plan without taking my consent?
what is the remedy?

File appeal before appellate authority and move for stay. Obtain stay from court against construction.

Are you sure that the property is ancestral?

If yes: there might be other Legal heirs also having their share.

Or it was self acquired in the hands of your father.


You might have submitted death certificate and Legal heir certificates of, Father to O/o Authority under whose jurisdiction property falls for updation of inheritance in mutation records and obtained latest copy.


The mutation records must have shown inheritance in the names of legal heirs e.g; you and brother.

Preferably show all docs to a very able counsel of unshakable repute and integrity at your location specializing in revenue/property/civil matters, for a considered opinion, and proceed under expert advice of your counsel.
