Belif service by mumbai sheriff - >>>free or paid

(Querist) 02 July 2017 This query is : Resolved 
Serving testamentary citations in Mumbai is handled by office of sheriff . Since we paid huge ( rs 75000/-) as probate fees it was presumed that it covers the fees for belief's service .Ground situation is that the belief is not ready to serve citations unless paid for which is unrealistic
Tried to get facts from court ,sachivalaya but failed
Can anybody put highlight the facts for me & for public in general .

Have you appointed a court clerk working in High Court regularly to handle your matter? If not then please do so at the earliest as they will be able to liaison and get the service done. Be practical as long as it is reasonable.

1. There is no such thing as "probate fees". FURTHER, the Law CANNOT run on "presumptions or hallucinations".

2. The Rs. 75,000/- paid on Probate application /proceedings, is classified as "Court Stamp Fee" and NOT "probate fees", under the Court Rules. For "Court Stamp Fee", the Court /State does NOT provide any services, whatsoever, which includes "bailiff" service or whatever.

In every court, apart from the court fee, the party concerned has to meet expenses towards each of the steps involved. in practical terms, the advocate clerk would take care of all these aspects, for a fee of course.
It is a fact that much of the procedure in Bombay High Court (original Side) is a bit archaic.
