Ancestral property law

Querist : Anonymous (Querist) 06 October 2018 This query is : Resolved
My grandfather inherited ancestral agricultural land which was bought by his grandfather. My grandfather partitioned the property among his uncle's sons in the year 1954. The property is in Tamil Nadu.

My father and aunt were born before 1950.

My grandfather passed away in the year 1995. and my father passed away in this year. My aunt is alive. Could you please advise if my aunt or her children can claim this property.

Facts, as posted, is confusing. What do you mean by "My grandfather partitioned the property among his uncle's sons....................."?

Dear sir,

This was common property of my great- grandfather and his brother. The partition of this land happened, between my grandfather and his cousins (uncle's sons), only after my great- grandfather & his brother's demise.

As per me, your aunt can claim the property.

After partition, the property looses its status of ancestral so she is not entitled to inherit any share.

Was the partition in 1954 through a registered deed, with the grandfather relinquishing his share, may be for some quid pro quo?
