MADRAS HC DIRECTED STUDENTS TO BEHAVE PROPERLY

Madras High Court has observed that students should behave properly in colleges as misbehaviour in college campus would not only tarnish the image of the institution, but also affect other students.

Allowing a writ petition filed by a student challenging the action of a college in Puducherry removing him from the rolls, Mr Justice K Venkataraman said he hoped that the student would realise his mistake and behave in a manner that would fulfil the aspirations of his parents and teachers.

In his petition, M Kugapriyan submitted he hailed from a poor family and joined the B.Com (Foreign Trade) course in Indira Gandhi College of Arts and Science in Puducherry.

He along with three other students were suspended for alleged misbehaviour in the class room and an inquiry was on.

The college removed him from the rolls in March this year.

As a consequence, he was not eligible to write the University semester examination, he submitted.

His parents met the college Principal and requested him to show mercy. Following the request by his father, the college said the student had to redo the course from the fourth semester, which would commence from January 2009.

The Judge said if the petitioner had misbehaved, he could not be allowed to go scot-free. However, though several allegations had been made against the student, no proper inquiry was conducted against him.

In the suspension order citing mis behaviour, it had not been stated what the misbehaviour was. Thus, the order removing the petitioner from the college was strange, the Judge said.
