SC: COLLEGIUM RECOMMENDS TRANSFER OF JUDGES INVOLVED IN GPF SCAM 12/22/2008 The Supreme Court collegium headed by Chief Justice K G Balakrishnan has recommended the transfer of four High Court judges who are facing allegations of involvement in the Ghaziabad District Court GPF scam. Justices Sushil Harkoli, Tarun Agarwal, R Mishra, all from Allahabad High Court and Justice J S Rawat from Uttarakhand are to be shifted to some other HC to ensure free and fair investigation into the scam which is being carried out by CBI. The main accused in the scandal, Ashutosh Asthana, in his statement to the special judge had named 36 judges, including a sitting SC judge, 11 HC judges and 24 District Court judges, who are facing allegations of being beneficiaries of the ill-gotten money. Justice Balakrishnan had handed over the investigation of the scam to CBI after local police expressed its inability to investigate the matter in view of the involvement of the judges, before whom they have to appear regularly. The SC collegium had earlier refused to confirm Justice A K Singh, Additional Judge of Allahabad HC, as a permanent judge when his name also cropped up during the investigation. According to Ghaziabad District Court Bar Association, the total amount fraudulently withdrawn between 2001 and 2007 is Rs 21 crore and not Rs 7 crore as alleged in the FIR.
