4/2/2009 Taking series note of inaction in custodial disappearance case, Jammu and Kashmir High Court has directed police to produce all records of a 12-year-old case in the court. The court direction came after the petitioners counsel alleged that police has failed to take any further action even after an inquiry officer, appointed by the court, has clearly said Mushtaq Ahmad Dar disappeared after his arrest by the security forces in April 1997. A single bench of the High Court comprising Justice Imtiyaz Hussain directed the in-charge of the Primpora police station to submit the case dairies. According to petition filed by the Dars family, he was arrested on April 13,1997 by the security forces. It said he was not released even after paying Rs 20,000 to a security force officer. Later, the family approached the court and District Sessions Judge, Srinagar, was appointed an inquiry officer to probe the case. The Judge, after recording all statements, in its report said that Dar was arrested and later forced custodial disappearance by the security forces. On the direction of the court, a formal FIR was registered in Parimpora police station some six years ago. Praying for justice, the petitioner said nothing has been done by the police even though Dar disappeared 12 years ago and case was filed six years back.
