Criminal Law : Aarushi murder: SC dismisses plea against narco-analysis test

The Supreme Court on Thursday refused to entertain a petition seeking to restrain CBI from conducting narco-analysis test on the suspects in Noida's Aarushi-Hemraj murder case.

The petition was filed by All India Lawyers Joint Action Committee, an unregistered body of lawyers.

Refusing to entertain the plea, a bench headed by Justice Altamas Kabir said the lawyer's body had no locus standi in the case as it was not a registered entity in law and, therefore, the petition was not maintainable.

The court allowed the advocate to withdraw the petition giving him the liberty to file it in his personal capacity.

The petitioner had also questioned the procedure adopted by the CBI for conducting the polygraphic and narco-analysis test on the suspects and the accused.

The counsel said that the investigating agency had gone ahead and conducted the narco test on the suspects despite having the knowledge that its validity has been challenged in before a Constitution Bench of the apex court.
