withdrawal of funds from the BANK ACCOUNY OF COMA PATIENT

Sir,
An employee is in COMA since last few months. I work in ESIC and on the basis of his dependents statement and medical certifications, our office have credited his benefit amount to his account.
However, his bank is not allowing his nominee or the dependents to withdraw the amount.
Now being the sole bread earner of his family, the dependents of his family members does not have any money for even his medical treatment.
I HAVE TO REQUEST YOU TO KINDLY MENTION IF ANY PROVISION IS AVAILABLE SO THAT HIS NOMINEE OR DEPENDENTS MAY WITHDRAW THE AMOUNT FROM HIS BANK ACCOUNT.

GO thru guidelines of bank that should be available on website, in bank framed in accordance with RBI guidelines and should be provided  to family without any cost..

9.2 Types of sick / old / incapacitated account holders

The cases of sick / old / incapacitated account holders fall into following categories:

(a) An account holder who is too ill to sign a cheque / cannot be physically present in the bank to withdraw money from his bank account but can put his/her thumb impression on the cheque/withdrawal form;

(b) An account holder who is not only unable to be physically present in the bank but is also not even able to put his/her thumb impression on the cheque/withdrawal form due to certain physical incapacity.

9.3 Operational Procedure

With a view to enabling the old / sick account holders operate their bank accounts, banks may follow the procedure as under:-

  1. Wherever thumb or toe impression of the sick/old/incapacitated account holder is obtained, it should be identified by two independent witnesses known to the bank, one of whom should be a responsible bank official.
  2. Where the customer cannot even put his / her thumb impression and also would not be able to be physically present in the bank, a mark can be obtained on the cheque / withdrawal form which should be identified by two independent witnesses, one of whom should be a responsible bank official.
  3. The customer may also be asked to indicate to the bank as to who would withdraw the amount from the bank on the basis of cheque / withdrawal form as obtained above and that person should be identified by two independent witnesses. The person who would be actually drawing the money from the bank should be asked to furnish his signature to the bank.

Try to get help from senior officials e.g; Circle manger, Chairman, of Bank or

CEPD;RBI..’ expalining the hardship and willingness to complay with laid rules/guidelines...indemnity etc
